Hi Victoria,

Apologies for being late to the party with this response - are you familiar with the Graphic Artist’s Guild Handbook of Pricing & Ethical Guidelines? This book gets updated every 3-5 years, and it’s one of the more comprehensive collections out there of industry pricing and practical guidelines - for creatives in a broad range of specialized fields within the umbrellas of Illustration and Graphic Design. The book also contains sample contracts, project agreements, and invoices, to use as a guide in creating your own.

Much of my work is in commercial illustration - a significant percentage in product packaging and branding - and the GAG handbook has been instrumental for me in establishing pricing structures and understanding licensed rights. One must always take these guides as a starting point only, then factor in what you know about your particular area, your experience and expertise, and of course the client themselves - but it can be a great help to have a place to start.

If the work you’re being asked to do equates to branding (not just illustration for a product package, but illustration that becomes a sort of logo mark) then it is common practice to sell the work with full exclusive rights - by nature, branding should remain 100% unique to the user. By contrast, if the illustration is distinctive, but in no way part of the actual branding, there are all manner of licensing structures to consider.

Best of luck with the project!
-Natalya

What sort of licensing agreement should I have for that (this is my first time doing something like this) and do I keep the copyright or do they, and what can they do to protect someone from stealing the image, that I made for them, and using it?
