Derivative works are protected by the copyright laws, also

   slight changes to an image "used" carries about as much weight as 
"rendering it in another medium"     the resultant image would need 
to be way different from the resource, so as to be clear it is not 
the same....   there isn;t enough differences in these 2 images to 
spit on....    1 hour with photoshop would yield this result.

    besides, she admitted using this photo....    I would be 
interested in hearing her "fair use" argument........
